Employee data protection has always been subject to a delicate balance of competing interests. Employers have legitimate organisational, monitoring and security interests. Employees, on the other hand, are entitled to the protection of their personal data, their privacy and their personal rights.
The article analyses these interests from a legal policy perspective and demonstrates why data protection in the employment relationship poses particular challenges. Unlike in many other legal relationships, employers and employees are not entirely on an equal footing. It is precisely for this reason that data processing in the workplace must be particularly carefully justified, limited and organised in a transparent manner.
The publication remains relevant today because digital tools, monitoring, compliance systems, internal investigations and AI-supported applications raise new questions regarding employee data protection. The article thus provides an early foundation for discussions that have since gained even greater practical significance in labour and data protection law.
