In episode 194 of ‘Follow the Rechtsstaat’, Thomas Fuchs, Hamburg’s Data Protection Commissioner, is a guest on Prof. Niko Härting’s programme. The focus is on Meta’s Smart Glasses and the question of under what conditions their use is possible in compliance with data protection regulations.
In particular, the two discuss the recording of other individuals and the scope of the household exception under Article 2(2)(c) of the GDPR. This also touches on recent questions referred by the Federal Court of Justice to the European Court of Justice, as well as a possible ban on the glasses under Section 8 of the TDDDG.
Finally, they address the Bundesrat’s initiative against the planned centralisation of data protection supervision.
