Where we help
  • Passenger Transport Law

We assist car hire companies and fleet operators in obtaining and safeguarding licences and authorisations under passenger transport legislation. Furthermore, we advise and represent clients in relation to regulatory requirements and in defending against competition law claims, particularly in connection with the provisions of the Passenger Transport Act relating to car hire services.

  • Permits

When it comes to obtaining permits for cultural events, festivals and club events, we advise you on requirements under nature conservation law, the use of public green spaces under the Green Spaces Act, protection against environmental pollution, as well as special road use permits and traffic regulations under the Road Traffic Regulations (StVO). We guide you through the process with the relevant authorities and represent your interests in the event of conditions, restrictions or prohibitions, including in court.

  • Operators’ obligations

The requirements set out in the Public Gatherings Ordinance are complex and involve sensitive safety issues. We assist operators, event organisers and owners in complying with their obligations under public law, liaising with the authorities, and navigating authorisation and amendment procedures.

  • IFG

Requirements for transparency under Freedom of Information Acts (FOI) play a key role in many administrative procedures. We assist applicants in exercising their rights to information, advise public authorities and businesses on how to process FOI requests, and represent clients in appeal and legal proceedings.

  • Clubs and cultural organisations

We advise clubs and cultural organisations on requirements under trade and hospitality legislation, in particular on notification and licensing procedures under the Trade Regulation Act and hospitality legislation, on the protection of young people and non-smokers, as well as on opening hours, night-time operations, closing times and Sunday opening. We assist you in your dealings with regulatory authorities and represent your interests in relation to conditions imposed, complaints, prohibitions and fine proceedings, including in court.

  • Data Protection Law

We advise public bodies and businesses on how to design their processes in compliance with data protection regulations under the GDPR and the relevant specific statutory requirements. In doing so, we develop data protection strategies, assist with data protection impact assessments for high-risk processing operations, and represent your interests before data protection supervisory authorities.

  • Environmental Protection Legislation

Requirements under environmental protection legislation play a key role for cultural practitioners, clubs, cultural events and festivals. We advise you on planning permission procedures, in particular regarding noise control and protection of neighbours, as well as the requirements of the Technical Instructions on Noise (TA Lärm), the Leisure Noise Directive, the Event Noise Regulation and – in the case of sports facilities and sporting events – the 18th BImSchV, and represent your interests vis-à-vis the authorities and the interests of neighbours, in court if necessary.

  • Planning law

We advise cultural and events organisations on obtaining planning permission and on matters relating to planning law, in particular regarding the permissibility of event venues, clubs and changes of use in accordance with local development plans and in unplanned indoor or outdoor areas. We assist with planning permission procedures and represent your interests before building control authorities and in administrative courts.

  • Advertising in public spaces

Out-of-home advertising in public spaces is subject to a wide range of restrictions under public law. We advise providers and advertisers on OOH advertising, obtain the necessary permits, review signage and advertising regulations, and challenge unjustified bans and removal orders.

  • Market determination / Authorisation

Whether it’s a weekly market, a specialist market or a trade fair: market authorisation and licensing procedures determine whether and how the event can take place. We assist you with pricing and authorisation procedures with the relevant authorities, help you prepare the necessary documentation, review selection decisions and conditions, and represent your interests in the event of rejections or restrictions.

  • Funding law

We review grant and recovery notices, including those relating to COVID-19 support, and represent your interests in dealings with funding bodies and before administrative courts. In particular, we assist with challenging unfounded or disproportionate recovery claims, reviewing decisions to annul or revoke grants, and addressing issues relating to reimbursement amounts and interest.

  • Public Procurement Law

Public procurement is subject to strict public procurement law requirements. We assist public contracting authorities and tenderers at every stage of the procurement process, from the design of the procedure and the publication of the notice, through tender strategies, to objections, review proceedings and judicial review.
